A legal scholar is questioning the premise of the ACT Party's 'one law for all' policy.
ACT's proposed changes aim to limit judges' recognition of Māori tikanga (custom) in court decisions, on the basis that a belief system has no place in objective justice. But Māmari Stephens from Otago University's theology team argues that legal concepts like equality and property rights have deep theological roots, and that tikanga (custom) has a long-recognised place in New Zealand's legal history which should be held in tension with Judeo-Christian precepts.
